Antamina reiterates its commitment to dialogue and understanding and ensures the normal course of activities

After the Dirección Regional de trabajo y Promoción del Empleo de Ancash (Auto Directorial N°005-2014- Región Ancash – DRTyPE/DPSC-CHIM) declared inadmissible the strike announced by SUTRACOMASA leaders, Antamina reiterates its readiness to dialogue and encourages its employees to think about the consequences this protest will bring to our company.
On Friday, November 7 at the Regional Working Chimbote, another meeting was held between representatives of the union and Antamina; however, this meeting did not materialize successfully because the Union representative who attended this event did not have proper legal representation.
The inadmissibility of the strike is granted by the labor authority which primarily indicates that Antamina has not breached any final judicial decision on any legal, labor or conventional obligation; and that the exercise of the right to strike implies having exhausted all direct negotiation between the parties, which is not applicable because the company is not negotiating a new collective agreement, but rather the current agreement is valid and in full compliance.
Once again, the company confirms that all necessary measures and safeguards will be provided to ensure the safety of workers who wish to continue their work.
Antamina calls SUTRACOMASA Union leaders to reflection, since the only thing that will be accomplished with a measure of force is a reduction in profit from a profit-sharing plan (Peruvian legal requirement), which is precisely the reason for the strike.
What will be the result of a strike if it materializes?:
1. Workers who will go on strike will be deducted on their payments for days not worked.
2. The share of profits of those who go on strike will be reduced to the extent that this distribution is proportional to the number of days actually worked and it is also proportional to lower compensation they will receive.
3. In case production is eventually affected and consequently the profits of the company, the amount of profits to be distributed will be less for everyone.
4. The company will not yield to this measure of force as it would set a precedent that it is the pressure and not the reason what will govern our relationships, breaking this way with what is and always has been the Antamina culture: dialogue and the search for win – win solutions.
5. What would be achieved by this strike is a lose-lose situation, which will be the sole responsibility of those involved in it.
We reiterate our call to reflection and lay aside attitudes that will only prejudice those conducting this strike.
